We also hope to make the online booking process easy and efficient; these terms and conditions are designed to ensure your satisfaction and understanding of the purchase process.
This page (together with the documents referred to on it) sets out the terms on which MotorSport Vision Limited makes available test days at its circuits for booking online. Please take the time to read these terms and conditions carefully before booking on this site - remember that our sales team can be contacted on 0843 453 3000 and will be happy to deal with any enquiries you may have.
By booking a test day, you agree to abide by these terms and conditions. Your booking and your participation in the test day are also subject to the Test day Regulations. If you do not agree to these terms and regulations, please do not proceed with your order.
About MotorSport Vision
The www.motorsportvision.co.uk website ("site") is operated by MotorSport Vision Limited ("MSV"), a company registered in England and Wales under company number 3446418 and with our registered office and trading address at MotorSport Vision Centre, Brands Hatch Circuit, Fawkham, Longfield, Kent DA3 8NG. MSV's VAT number is 824798388.
How the contract is formed between you and MSV
After placing an order, you will receive an e-mail from MSV acknowledging that we have received your order. Please note that this does not mean your order has been accepted. Your order constitutes an offer to MSV to buy a test day.
All orders are subject to acceptance by MSV, and MSV will confirm such acceptance to you by sending you an e-mail that confirms the test day has been purchased, together with a booklet that contains details of the test day regulations and general information relating to timings and organisation of your test day. The contract between us will be formed when we send you the confirmation email. By booking a test day through the site you warrant that you are legally capable of entering into binding contracts.
The confirmation email will also contain MSV's standard Registration Form. The terms of the Test day Regulations and Information booklet and the Registration Form will also apply to the contract between us.
If you do not receive the confirmation emails or you are unsure about any matter regarding your booking please call the sales team on 0843 453 3000.
Booking on behalf of Someone Else
Please note that if you are booking on behalf of someone else, you must ensure that such person(s) receive a copy of the Test day Regulations and Information booklet and the Registration Form. You also undertake to us that such person(s) will comply with all requirements set out in this agreement (including in the Test day Regulations). If they or their vehicles do not comply with the terms of this agreement (including the Test day Regulations) then MSV shall be entitled to prevent their participation in the test day or require them to leave the venue.
You will be responsible for bearing any cost incurred as a result of cancellation or the relevant person's non-attendance at the test day. We are unable to provide refunds other than to those customers who have booked directly with us.
If you have any doubt that anyone for whom you are booking a test day is or may not be able to comply with any of the terms of this agreement (including the Test day Regulations) please do not proceed with that booking and advise such person(s) to book direct or contact our sales team.
Price and Payment
The price of test day bookings will be as quoted on the site from time to time, except in cases of obvious error. These prices include VAT. Prices may change at any time but changes will not affect orders in respect of which MSV has already sent a confirmation email.
Payment must be by credit or debit card. We accept payment using Visa, Mastercard, Switch, Solo and Maestro.
Availability
All test days are subject to availability. Please check the details of your test day booking set out in the confirmation email as mistakes cannot always be rectified.
Cancellations
(a) Cancellation by MSV
MSV may have to cancel a test day due to events beyond its control, for example adverse weather conditions. This will usually be in the interests of safety. Where a test day is cancelled in its entirety for such reasons, MSV will endeavour to notify participants of the cancellation although MSV cannot guarantee that participants will be informed of such cancellation before the date of the event. Where a test day is cancelled in its entirety for such reasons, MSV will endeavour to offer either (a) a place on an alternative, later test day (subject to availability) up to the face value of the existing booking or, (b) if the test day is not rescheduled, a full refund.
If MSV cancel a test day for reasons other than events beyond its control, a full refund will be offered (we will endeavour to give as much notice as is possible but this cannot be guaranteed).
The circuit reserves the right to: session any day or move any machine from one session to another.
In order to claim any refund, please apply in writing to MSV's address set out at the start of these terms and conditions, stating clearly the test day to which the application relates. For accounting purposes any applications for refunds must be received within 28 days from the date of the cancelled test day.
(b) Cancellation by you
Any amendments to test day bookings must be requested in writing (which includes writing to our Testing Sales team at the address below or emailing us at biketesting@motorsportvision.co.uk), stating clearly the test day to which the amendment relates.
In the event of a cancellation, a refund will only be given if we receive more than 7 days notice, in writing,(i.e. if your test day is Friday the 20th, then we need to be contacted no later than 17.30hrs on Thursday the 12th). Between 7 and 3 days notice given, then your booking may be transferred at the discretion of the Operations Manager. Bookings will only be transferred once.
If 3 days or less notice is given, no refund or transfer will be issued.
All date transfers must be within three months of the original date booked. (Please note: date transfers will not be not given if a vehicle suffers any kind of mechanical failure).
Variations
MSV may vary the format and / or timetable of an event if required. Participants will be notified of any such change as soon as possible.
MSV may revise these terms at any time by amending this page or the relevant document. Please check this website from time to time to take notice of any changes made, as they are binding. Some of the provisions of these terms may also be superseded by notices or provisions published elsewhere by MSV at the venue.
Acknowledgement of Risk
Motorsport is dangerous and can involve injury or death. Despite MSV taking all reasonable precautions, accidents can happen. By attending a test day, you acknowledge this and confirm that you are aware of the nature of the activity and attend at the venue at your own risk.
MSV may refuse access to, and eject from, its venues any persons who are acting against the interests of safety and/or whose behaviour is likely to cause damage, nuisance or injury. MSV may also have to conduct security searches at the venues to ensure the safety of customers and other persons at the relevant event.
Neither MSV nor any other members of the MSV group of companies or their representatives are responsible for any loss, damage or injury to persons or of property caused or sustained by you as result of attendance at any test day, save for liability for death or personal injury arising from MSV's negligence or for fraudulent misrepresentation.
Jurisdiction and Applicable Law
The English courts will have exclusive jurisdiction over any dispute or claim arising from or related to these terms and conditions (and the documents referred to in them) and/or attendance at the venue. These terms and conditions (and the documents referred to in them) are governed by English law.
